A Debt Collector Is Suing Me

What to do if a debt collector files a lawsuit against you, and why you should not assume you will lose.

1 min read

Did you answer your door only to be handed legal papers saying a debt collector is suing you? Here's what you can do to defend yourself.

I am being sued by a debt collector

Call a consumer attorney immediately, and do not ignore the suit. If you fail to appear, a judgment can be entered against you and your wages and bank account could be garnished.

A debt collector must prove in court that you actually owe the money and that they have the right to collect it. Because collectors often operate with little documentation, they frequently lack this proof — so do not assume you will lose in court.
